Harvey Weinstein in Special Rikers Cell After Conviction Overturned

Convicted sex offender Harvey Weinstein was moved back to Rikers Island after his rape conviction was overturned. Weinstein is currently being housed in a special cell unit at Rikers’ West Facility for inmates with medical issues. His spokesperson confirmed that Weinstein is receiving medical attention while at the facility and that they are prepared to go to trial if necessary. The Appeals Court judges played a key role in overturning Weinstein’s conviction, citing issues with testimony from “prior bad acts” witnesses during the trial.

Weinstein, 72, was transferred to Rikers from Mohawk Correctional Facility in anticipation of his court date in Manhattan Supreme Court. Prosecutors are pushing for a retrial of Weinstein’s 2020 sex crimes conviction. The Manhattan District Attorney’s Office is committed to seeking justice for survivors of sexual crimes and will be focusing on the well-being of victims as they navigate the next steps in this case. Weinstein had been previously convicted in 2020 of one count of rape in the third degree and one count of a criminal sex act in the first degree.

The New York Court of Appeals overturned Weinstein’s sex crimes conviction, citing issues with the testimony of “prior bad acts” witnesses. Weinstein had been found guilty of forcibly performing oral sex on Miriam “Mimi” Haleyi and assaulting hairstylist Jessica Mann. Despite the conviction, Weinstein has denied the accusations and plans to face a retrial if necessary. Weinstein had been sentenced to 23 years in prison for his previous convictions.

Weinstein’s lengthy legal battles also include a 16-year sentence in Los Angeles for the forcible rape and sexual assault of an Italian model at the Mr. C Hotel in 2013. Weinstein is set to be extradited to California to serve this additional sentence once his time at Rikers is complete. Due to fears of potential harm, Weinstein had been housed in a special cell at Rikers during his first trial. Officials were concerned about a potential incident similar to that of Jeffrey Epstein’s suicide.

With numerous women coming forward as victims of Weinstein’s sexual misconduct, his legal battles are far from over.
